I'm not a lawyer by any means, and I know this happened when Mr. Elden was an infant; but if it was that bad (and it certainly does look like a questionable album cover to say the least), why didn't his parents sue the band back in the day, instead of just twiddling their thumbs for thirty years? Their inaction back then makes Mr. Elden, fairly or unfairly, look like a gold digger now (IMHO).

Pornographic? Hardly. But having said that, I wouldn’t have put my child in that situation. Did he have a say in that photo? No he did not. He might well have a case, but my question is, where is the parents/guardians responsibility in this? I would think they have as much responsibility for the photo as the band, photographer and record company do. I never once thought the photo “dirty” or anything wrong with it until this case came along. Now I can kind of see the guys point. Sounds like he is pretty proud of it more than anything. There are perv’s out there that would use the photo as porn so maybe that makes it porn? Not sure. How the hell DIDN’T anyone THINK this was a violation of the child’s rights? THAT, I find hard to believe, and if they did think it could violate the child’s rights, and went ahead with it, THAT is criminal IMO. IF they knew better and went ahead and did it. Which to me, seems very possible.
